Terms & Conditions
1. General
a. The information on this web site is current at the time of publication and may be subject to change.
b. The word ‘Client’ in the Terms & Conditions set out below also means ‘applicant’ or ‘partner’ or ‘agent on behalf of their client’ or ‘dependents of the client’.
c. Any visa application request submitted to Get2Aus by a partner or agent on behalf of their client will be deemed to be an application submitted to Get2Aus by the client. All terms and conditions listed herein apply to both the partner or agent and the client equally.
d. Get2Aus acts as an agent on behalf of its clients and these Terms & Conditions govern the provision of all services provided by Get2Aus in the processing and submission of visa applications and other ancillary services for their clients to the appropriate institutions and/or immigration authorities.
e. Get2Aus is entitled to include additional Terms & Conditions should the need arise. The submission of an application to Get2Aus constitutes agreement to these Terms & Conditions, including amendments thereto, by the client.
f. If Get2Aus introduces or refers the client to ancillary or related products of other businesses, then the client is bound by the Terms and Conditions of that business which may be different to the Terms and Conditions of Get2Aus.
g. Correspondence between Immigration Authoroties and Get2Aus with regards to any visa application is strictly confidential and is not subject to further distribution to third parties (including main applicants).
h. By making payment (partial or in full) for our service, it is deemed that you have read and agreed to abide by our Terms & Conditions as set out here. Get2Aus reserves the right not to provide any service without the client agreeing to our terms and conditions as set out here.
i. Get2Aus aims to process the visa application in the timelines mentioned in its promotional materials. These timelines should be used as a guide only and Get2Aus will use its best endeavours to minimise any delay or inconvenience caused in this respect. However, Get2Aus does not guarantee time guidelines for any visa application. Get2Aus will not be held responsible should the immigration authorities or any other third party change their rules, regulations or processing requirements and that change has a direct effect on the timeline for delivery.
j. Get2Aus will always lodge a visa application in the client's best interest. We are a private company and do not have the authority to grant visas of any kind. We cannot guarantee a positive result on a visa application or any assessment thereof. The final decision on all applications rests with the relevant organization responsible for issuing that result.
k. Get2Aus cannot influence or have the authority to challenge:
i. any decision made by an immigration authority
ii. any requests for additional information before finalising a visa
iii. any delay by an immigration authority in the issuing of a visa
iv. any terms of any visa issued
v. the activation date placed on a visa
vi. or a decision to refuse or grant a visa.
l. Get2Aus will not provide a continuation of further service (including the lodgement of a visa application) until a required stage payment has been made in full. Get2Aus is not responsible for any repercussions of not providing the service in question as a result of non-payment.
m. Our prices may need to be changed without prior notice as our prices are governed by exchange rates and changes in immigration costs.
n. Get2Aus reserves the right to contact your sponsoring employer should further details be required from the authorities or for confirmation of your application.
o. Get2Aus reserves the right, at our discretion, to change our product providers or any other parties involved in providing any of our ancillary services/products as deemed appropriate by Get2Aus.
p. Get2Aus reserves the right to return any passport without the requested visa if the passport or the documents provided do not comply with the immigration requirements or if there is insufficient time to process the visa.
q. A visa may be cancelled at any point after the Visa Grant Letter is issued and if it is discovered that the information provided via Get2Aus to the immigration authorities for the purposes of the visa application is deemed to be false and/or misleading information. Get2Aus will consequently not be responsible/liable for any costs, inconvienance or grievances.
r. The client agrees to receive future updates to products and/or services that Get2Aus offers where the information is relevant to the products that the client has initially purchased, enquired about or registered for with Get2Aus.com. You can opt-out of receiving any further correspondence by emailing Visas@Get2Aus.com or calling Get2Aus anytime and request to be removed from our mailing list.
2. Exclusions and Exceptions
a. Get2Aus is not responsible or liable when you break any existing visa terms and conditions (including overstaying) that you hold or have previously held which results in you subsequently becoming illegal in another country. It is your responsibility to ensure that you remain legal at all times while you are in another country.
b. Get2Aus will not be held responsible for costs incurred by an applicant or any secondary applicants while waiting for a visa to be finalised by the immigration authorities or due to a delay in the visa process due to circumstances outside of our control.
c. Get2Aus is not liable for any costs arising from any action, delay or refusal in the visa application process of any immigration authority, embassy or government body associated with the visa process or indeed for the non-provision of service from any third party associated with the visa process or delivery thereof.
d. Get2Aus will not be liable for any visa application being refused or becoming ineligible or any costs arising from such a refusal should situations of outdated information arise:
i. In the event where immigration laws and/or regulations have been updated by an immigration department but such updates have not been made known to the public at the time of visa lodgement
ii. in the event where immigration advice provided by one immigration officer or consular official conflicts with that of a visa issuing immigration officer at the port of entry
e. Get2Aus cannot be held responsible for any expense and/or delay arising from incomplete application forms, inaccurate/false or incomplete information provided or inaccurate/false or incomplete supporting documentation.
f. Get2Aus will not be held responsible for any loss or damage caused by an embassy/consulate issuing an incorrect visa or incorrect details on a visa.
g. Get2Aus is not responsible to compensate you for any loss, damage or delay of passports or travel documents by any third party courier/delivery company.
3. Refunds
a. If a client submits a refund request within 1 hour of making payment, they may be entitled to a partial refund if the service (professional advice and expertise) has not been provided to them and/or work has not commenced on their file.
b. No refund of any fees paid to Get2Aus will be made where the visa application has been lodged to the Immigration Authorities regardless of the reason for withdrawal.
c. Document assessments or pre-checks are non-refundable:
i. should the client decide not to proceed with the application for whatever reason once Get2Aus has begun to assess the client's documentation
ii. if an application has become ineligible due to Immigration policy changes that have been introduced between when the application was accepted by Get2Aus but before the application is lodged to the Immigration Authorities
d. No refund of any fees paid to Get2Aus will be made should you withdraw a visa application that you have kept on hold for a period longer than 6 months, regardless of the status or progress made of the application.
e. Get2Aus operates a strict no refund policy for all ancillary services/ products.
4. Client Liabilities
a. The Client is reminded not to make any firm bookings (e.g. flights, travel, accommodation, etc.), give notice of intent to leave any job or indeed sell any property until your visa is granted and received unless the embassy has specifically requested evidence of this as a requirement for the visa application.
b. It is the client's responsibility to provide Get2Aus with all required information and documentation concerning an application. This may include but is not limited to documentation from third parties such as partners, family, employers, sponsors, assessment bodies, educational bodies, etc. If the required documentation does not meet with the requirements of Get2Aus, Get2Aus retain the right not to lodge that visa application until it has received all of the required information in order to do so.
c. If an immigration authority has incorporated a deadline for the submission of documents to an application, these documents must be provided to Get2Aus at the earliest possible time but no later than 48 hours prior to the deadline date.
d. Get2Aus will use and rely on information provided by the client in the provision of services to that client. Get2Aus will not independently verify or assume responsibility for the accuracy or completeness of such information.
e. Additional cancellation fees apply in cases where you wish to cancel a visa that has been approved.
f. It is the client's responsibility to ensure that the documentation provided to Get2Aus at the time of submitting a visa application is valid and within date and not less than 30 days prior to the date of the expiry of that result.
i. Certain documentation required for a visa application may be valid for a certain period of time and become invalid thereafter (e.g. medicals – 12 months, skills assessment results – limited time, police clearance reports – 12 months, etc.).
ii. It is the client's responsibility to become familiar with the period of validity of these various documents.
iii. The client is responsible for any associated costs of these documents.
g. The client is responsible for any additional fees that may be required to facilitate the visa application or ancillary service including but not limited to fees in connection with medical reports, Chest X-rays, court documents, couriers, translation services, certification of documents, police checks or passport renewals.
h. You must travel with the same passport you hold at the time of completing your application. If you obtain a new passport after your visa has been issued, you need to contact the Get2Aus to have your visa re-allocated to your new passport. In this case, re-allocation fees apply.
i. It is the client's responsibility to ensure that he/she is familiar with his/her visa activation date and that the client enters the country to activate his visa before the visa activation date expires. A visa is liable to be cancelled after the expiration date and if the client has not entered before this date. The client bear's all responsibility and liability in such situations.
j. It is the client's responsibility to ensure that he/she reads, understands and abides by the visa conditions detailed in the Visa Grant Notification letter.
k. It is the client's responsibility to check and ensure that the Visa Grant Notification letter and the passport details on the visa letter appear exactly as they appear on the passport. Incorrect information may result in significant delays/missed flights/additional travel expenses/not being allowed to enter the country.
l. It is the client's responsibility to declare any facts which may adversely affect your case via an email prior to engaging our services. This may include but is not limited to serious medical conditions and serious criminal convictions. Non-disclosure of such pertinent facts may result in the visa application being delayed or refused.
5. Get2Aus Liabilities
a. In the event of loss or damage to any passport or documents received by Get2Aus, our liability will be limited to the actual value of the passport and documents up to a maximum of AU$100 per paid application. Get2Aus accepts no liability for consequential loss.
